I Elijah M. Oliphant of Little Creek Hundred Sussex county and State of Delaware, Make and publish this my last will, hereby revoking all other last wills and testaments by me heretofore made. I give devise and bequeath my estate and property real personal and mixed as follows, to wit-

My will is that all my Just debts and funeral charges shall by my executors hereinafter named be paid out of any estate, as soon after my decease as shall by them be found con? .

Item- It is my will and desire that my executors shall settle with my wife Sarah E. Oliphant according to our marriage contract, and pay to her or her heirs the four hundred dollars ($400) according to said contract within six months after my decease and I also give and bequeath unto my said wife in addition to our marriage contract our large Plaid Carpet, Our throw boltons, Rocking chair, our Large Parlor Lamp and all Rugs in the house at the time of my decease, also our dozen Hens.

Item 2nd- I give and bequeath to my son Theophilus B. Oliphant a note which I hold against him for seven hundred and ninety seven dollars and seventy eight cents ($797.78) and two dollars and twenty two cents in money so that he shall have Eight hundred dollars ($800.00)

Item 3rd- I give and bequeath to my son Isaac D Oliphant Eight hundred Dollars in money to be paid by my executors herein named within one year of my decease. To him his heirs and assigns forever.

Item 4th- I give and bequeath to my son William H. Oliphant Eight hundred dollars ($800.00) which is to be a credit on a Note I hold against him and the remainder that may be due on said note is to be paid into my estate to him, his heirs executors, administrators and assigns forever.

Item 5th- I give and bequeath to my son Nutter E. Oliphant eight hundred dollars ($800.00) which includes the balance due on a Note I hold against him and the remainder is tobe paid in money out of my estate to him, his heirs, executor administrators and assigns forever.

Item 6th- I give and bequeath to my son Jasper W. Oliphant a Note of Eight hundred dollars ($800.00) which I hold against him but he is to pay the interest on said note into my estate to him, his heirs, executors, administrators and assigns forever.

Item 7th- I give and bequeath to my daughter Martilla Hearn Eight hundred dollars ($800.00) which includes a Note I hold against her husband James E. Hearn and the remainder is to be paid in money out of my estate to her her heirs executors, administrators and assigns forever.

Item 8th- I give and bequeath to my son Elijah Oliphant a note of $800.00, which I hold against him, but h is to pay the interest on said note into my estate to him, his heirs, executors, administrators and assigns forever.

Item 9th- I give and bequeath to my daughter Sallie E. Ellis eight hundred dollars ($800.00) which includes a note I hold against her husband George F. Ellis and the remainder is to be paid in money out of my estate to her, her heirs, executors, administrators and assigns forever. It is my will that the land where I now reside, which is about 55 acres, shall be sold at a public sale and the money arising from said sale shall go into my estate.

Item 10th- It is my will that after paying all my Just debts and legacies and placing enescapble limbs into my grave tht the residue of my estate ont he proceeds thereof shall be equally divided between all my children Theohilus B., Issac D. Wm. H., and Nutter E. Oliphant, Jasper W. Oliphant, Martilla Hearn, Sallie E. Ellis and Elijah Oliphant to them their heirs executors administrators and assigns forever

Lastly I nominate and appoint my two sons Jasper W. Oliphant and Elijah Oliphant Executors of this my last will. In witness whereof I have signed and sealed and published and declared this instrument as my last will at Laurel delaware on this 8th day of April AD 1910.

The said Elijah M. Oliphant did sign and seal the above instrument and published the same in our presence to be his last will. And we at his request and his presence and in the presence of each other subscribe our names and witnesses
